- Central Valley Broadband Acceptable User Policy
- Please read the following as it set forth the guidelines for Acceptable User Policy for the Central Valley Broadband, LLC. (CVB) service and sets forth conduct that is prohibited.
Central Valley Broadband, LLC. (CVB) has established this Acceptable User Policy to help protect our customers, to enhance the use of the internet and the internet community, from unacceptable use or illegal activities. All users of Central Valley Broadband Wireless Broadband Internet Services are bound to comply with the Policy. You should also read our Terms of Service Agreement and Privacy Policy. If you do not agree to be bound by this policy you must end your use of our service.
Account holders of Central Valley Broadband’s services should be aware that there is content on the internet which might be offensive or does not comply with all laws, regulations or rules. Therefore we recommend that you use software designed to limit access to some material on the internet. Central Valley Broadband supports unrestricted use of the internet and does not assume responsibility for content on the internet and has no obligation to monitor transmissions under normal circumstances. As a Central Valley Broadband customer you bear full responsibility for communications and content provided through Central Valley Broadband’s service.
You agree to that Central Valley Broadband has the right to monitor transmissions when necessary and to disclose violations as required by law, regulation or other government requests. As mentioned in our Terms of Service Agreement, we may remove any content that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this Policy.
Central Valley Broadband will cooperate with law enforcement authorities when necessary and expects all account holders to notify us of any legal violations, violations of this policy or other matters of concern.
Violations of Central Valley Broadbands Acceptable User Policy
The following constitute violations of this Acceptable User Policy and you agree to restrain from these activities:
- Unsolicited E-mail: Using this service to send unsolicited e-mail is prohibited. Sending large quantities of unwanted or unsolicited e-mail (spamming or e-mail-bombing) to individual e-mail accounts is prohibited.
- Obscene Material: Posting, or transmitting obscene material or child pornography is prohibited.
- Harm to Minors: Using the Central Valley Broadband service to harm or attempt to harm. endanger, harass, or otherwise threaten minors in any way is prohibited.
- Threats. Using the Central Valley Broadband service to transmit any material (by e-mail, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property.
- Harmful Use: You may not use the Central Valley Broadband service to post or transmit any unlawful, abusive, libelous, defamatory, threatening, vulgar, obscene, indecent, hateful, or otherwise objectionable information of any kind.
- Harassment: Using the Central Valley Broadband service to transmit any material by e-mail, uploading, posting or otherwise that harasses another either by the frequency of activity or by contents prohibited.
- Fraudulent Activity: Using the Central Valley Broadband service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as pyramid schemes and chain letters. E-mail that consists of make-money-fast schemes, pyramids or chain letters, unsolicited commercial information and/or information offensive to the recipient is prohibited.
- Impersonation or Forgery: Using the Central Valley Broadband service to send e-mail or newsgroup articles or postings using a name or address of someone other than yourself, attempting to impersonate any person, or using forged headers or other identifying information is prohibited. Adding, removing, or modifying identifying network header information in an effort to deceive or mislead is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
- Illegal Use or Potentially Illegal Use: Using the Central Valley Broadband service to transmit or make available by e-mail, uploading, or otherwise, any material that, intentionally or unintentionally, violates any applicable local, state or national or international law, or any rules or regulations promulgated there under or give indication that such violation may be occurring. By way of example, and not limitation, such activity would include the receipt or distribution of material potentially deemed obscene under current statutes or the offering of child pornography and related activities.
- Unsolicited Commercial e-mail/ Unsolicited Bulk e-mail: Using the Central Valley Broadband service to transmit any unsolicited commercial e-mail or unsolicited bulk e-mail (spamming) is prohibited. Activities that have the effect of facilitating unsolicited commercial e-mail or unsolicited bulk e-mail whether or not that e-mail is commercial in nature, are prohibited.
- Unauthorized Access and Privacy Violation:. Using the Central Valley Broadband service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Central Valley Broadband or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data. Security violations include but are not limited to:
- attempts to compromise or gain unauthorized access to any other Internet account or unauthorized system
- altering the header of e-mail messages that conceal your e-mail address or prevents recipients from responding
- interfering with any user, system or network, including any denial of service attack
any use or distribution of tools designed for compromising security including cracking tools, network probing tools, programs for guessing passwords or credit card numbers and any application that allows the remote control of another system without the knowledge of that systems operator.
- Collection of Personal Data: Using the Central Valley Broadband service to collect, or attempt to collect, personal information about third parties without their knowledge or permission is prohibited.
- Reselling the Central Valley Broadband Service. Reselling the Central valley broadband service without Central Valley Broadband’s written authorization is prohibited.
- Transmission of Destructive Materials: Posting or transmitting any information or software which contains a virus, lock, key, bomb, worm, trojan horse or other harmful component is prohibited.
- Network disruptions and unfriendly activity. Using the Central Valley Broadband service for any activity that adversely affects the ability of other people or systems to use the central Valley Broadband service or the internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, network services, web sites or network equipment is prohibited. It is the Customer's responsibility to ensure that their network is configured in a secure manner. A Customer may not, through action or inaction, allow others to use their network or access for illegal or inappropriate actions. A Customer may not permit their network, through action or inaction, to be configured in such a way
Unauthorized use or Account Sharing: Sharing accounts with anyone other than immediate family members is prohibited.. Running programs or servers that provide network services to others through the Central Valley Broadband such as web hosting, multi-user interactive forums, game servers is prohibited. You may not obtain or attempt to obtain the Central Valley Broadband service by any means or device with intent to avoid payment. Accordingly, Central Valley Broadband maintains the right to terminate any customer's connection following any extended period of inactivity as determined by Central Valley Broadband in its sole discretion.
- Excessive Bandwidth or Disk Utilization: Central Valley Broadband’s account descriptions and our Terms Agreements specify limits on bandwidth and disk utilization, and use in excess of those limits is not permitted.. In the event Central Valley Broadband determines that an account is exceeding the bandwidth or disk utilization, the account owner will be notified by e-mail.
- Copyright Infringement or Trademark Infringement: Using the Central Valley Broadband service to e-mail, upload, post, transmit, reproduce, or distribute in any way, information that infringes any copyright, trademark, patent, trade secret , or other proprietary rights of any third party, including, but not limited to the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
- System monitoring: Central Valley Broadband has no obligation to monitor the service. You agree that Central Valley Broadband has the right to monitor the service electronically from time to time, and you consent to Central Valley Broadband’s access, use and disclosure of any information as necessary to satisfy any law, regulation or other governmental request, to operate the serviced properly or to protect itself or its customers. It may be necessary for Central Valley Broadband employees to examine system logs and other records to resolve system problems. Central Valley Broadband reserves the right to access a user's mailbox to resolve system problems or mail system errors.
- Data Security: Central Valley Broadband makes no guarantee and assumes no liability for the security of any data on any server including "secure servers." You are reminded that no computer system should be considered safe from intrusion. e-mail may pass through many computer systems, and should not be considered a secure means of communication unless encrypted. Even then, information is only as secure as the encryption method and the continued protection given by the recipient.
- Viruses / Worms. To introduce viruses, worms, harmful code and/or Trojan horses on Central Valley Broadband’s network is prohibited. You are responsible to ensure that your computer has a working and up-to-date Antivirus and Anti Spy ware program installed and running at all times.
- Spamming, Flaming, Hacking. To use the network for spamming, flaming, hacking or otherwise obtain unauthorized access is prohibited.
- Enforcement: Central Valley Broadband reserves the right to suspend, block or cancel access to its service when, in our judgment and sole discretion, an account is in violation of this Acceptable User Policy. Central Valley Broadband, by way of example and not limitation, may take any one or more of the following actions in response to complaints of conduct that amounts to a violation.
Issue written or verbal warnings.
Suspend the Customer's account
Terminate the Customer's account
Bring legal action to enjoin violations and/or to collect damages, if any, caused by violation
Revisions to this Acceptable Use Policy
This document provides a general understanding of Central Valley Broadband’s policy on the appropriate use of their services. Central Valley Broadband reserves the right to revise, amend, or modify this policy.
